Terms of Service

These Terms of Service ("Terms") govern your access to and use of Beacon, a private financial dashboard provided by [Beacon - Financial Clarity Inc] ("Beacon," "we," "us," or "our") at findyourbeacon.app and through related services (the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

IMPORTANT: Beacon is a deterministic modelling and personal record-keeping tool. It is not financial, investment, tax, legal, or retirement planning advice. See Section 7 (Financial Disclaimer) for the full terms.

1. The Service

Beacon is a private financial dashboard that allows you to manually record account balances, model projections based on assumptions you supply, and visualise progress toward a financial independence target you define.

Beacon does not connect to banks, brokerages, or other financial institutions. All data in your account is entered manually by you. Beacon does not execute trades, move money, or hold custody of any assets.

2. Eligibility and Accounts

2.1 Eligibility

You must be at least 16 years of age and capable of forming a binding contract under the laws of your jurisdiction to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2.2 Account Registration

To use the Service you must create an account using a valid email address and password, or by signing in with a supported third-party authentication provider (such as Google). You are responsible for:

Maintaining the confidentiality of your account credentials.
All activity that occurs under your account.
Notifying us immediately of any unauthorized access or security breach.

We are not liable for any loss arising from your failure to safeguard your credentials.

3. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any applicable law.
Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by applicable law.
Use automated tools, scrapers, or bots to access the Service without our written permission.
Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
Upload or transmit malicious code, or use the Service to harass, abuse, or harm any person.
Resell, sublicense, or commercially redistribute access to the Service without our written permission.

We may suspend or terminate accounts that violate these rules.

4. Your Data

4.1 Ownership

You retain all rights to the financial data you enter into Beacon ("Your Data"). We do not claim ownership of Your Data.

4.2 License to Operate the Service

You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display Your Data solely as necessary to operate, maintain, and improve the Service for you.

4.3 Export and Deletion

You can export Your Data as CSV at any time from inside the Service. You can delete your account and associated data from the Profile screen. Data deletion is governed by our Privacy Policy.

4.4 Backups

We maintain operational backups for reliability and disaster recovery. You are responsible for keeping your own copies of Your Data if you require independent backups.

5. Intellectual Property

The Service, including its software, design, branding, name, logo, and content (excluding Your Data), is owned by Beacon - Financial Clarity Inc. and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal, non-commercial use, subject to these Terms.

"Beacon" and the Beacon logo are trademarks of Beacon - Financial Clarity Inc.. You may not use them without our prior written permission.

6. Subscriptions, Fees, and Payments

If the Service is offered free of charge, we may introduce paid plans in the future. We will provide reasonable notice before charging for features you currently use.

If the Service includes paid plans, fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable except where required by applicable law. You authorize us, through our payment processor, to charge the payment method you provide. You are responsible for all applicable taxes.

You may cancel a paid subscription at any time. Cancellation takes effect at the end of the current billing period.

7. Financial Disclaimer

Beacon is not a financial advisor, investment advisor, broker-dealer, tax advisor, accountant, or fiduciary. Nothing produced by the Service constitutes financial, investment, tax, legal, accounting, or retirement planning advice.

7.1 Modelling Tool, Not Advice

Beacon is a deterministic modelling tool. Projections, financial independence dates, target amounts, charts, and other outputs are generated by applying simple mathematical formulas to assumptions you enter, including growth rates, withdrawal rates, contribution amounts, and inflation rates.

These outputs are illustrative only. They are not predictions, forecasts, recommendations, or guarantees of future performance. They do not account for taxes, fees, market volatility, sequence-of-returns risk, changes in personal circumstances, regulatory changes, or any factor not explicitly entered by you.

7.2 Your Responsibility

You are solely responsible for:

The accuracy and completeness of any data and assumptions you enter.
All financial decisions you make, whether or not influenced by outputs from the Service.
Verifying any information from the Service before acting on it.
Consulting a qualified, licensed professional (such as a financial advisor, accountant, or tax professional) before making decisions about investments, retirement, taxes, or financial planning.

7.3 No Fiduciary Relationship

Use of the Service does not create a fiduciary, advisory, brokerage, or professional relationship between you and Beacon.

7.4 Past Performance and Assumptions

Default growth rates, withdrawal rates, and inflation rates provided by the Service are illustrative starting points, not recommendations. Past performance of any asset class or market is not indicative of future results. Real-world investment returns are not deterministic and will differ, often materially, from any projection.

7.5 No Endorsement

Beacon does not endorse, recommend, or advise on any specific investment, security, asset class, account type, financial institution, or strategy.

7.6 Acknowledgement

By using the Service, you acknowledge that you understand this disclaimer and agree that Beacon is not responsible for any financial outcome, loss, or decision you make in connection with the Service.

8. Third-Party Services

The Service relies on third-party providers, including Supabase (hosting, database, authentication) and Google (OAuth sign-in). Your use of those third-party services may be subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

9. Service Availability and Changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, infrastructure issues, or factors beyond our control.

We may add, modify, or discontinue features at any time. If we discontinue the Service entirely, we will provide reasonable advance notice and a window for you to export Your Data.

10. Suspension and Termination

You may terminate your account at any time by deleting it from the Profile screen.

We may suspend or terminate your account if you breach these Terms, if we are required to do so by law, or if continued provision of the Service to you presents a security or operational risk. Where reasonable, we will provide notice and an opportunity to cure the breach.

On termination, your right to use the Service ends. Provisions of these Terms that by their nature should survive termination (including Sections 4, 5, 7, 11, 12, 13, and 14) will survive.

11. Disclaimers of Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

We do not warrant that the Service will be error-free, secure, or that any output will be accurate or reliable. To the fullest extent permitted by law, we disclaim all warranties not expressly set out in these Terms.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BEACON AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, INVESTMENT LOSSES, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Beacon, its affiliates, and their officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or rights of any third party, or (d) any financial decision you make in connection with the Service.

14. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. You and Beacon agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario for any dispute arising out of or related to these Terms or the Service, except where prohibited by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date at the top reflects the most recent revision.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Beacon regarding the Service and supersede any prior agreements.

16.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

16.5 Notices

We may provide notices to you by email to the address associated with your account or by posting in the Service. Notices to us must be sent to the contact address in Section 17.
